Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Sexync platform, including the website at sexync.com and all associated services (collectively, the "Platform"). The Platform is operated by Bytenade Oy, a company registered in Finland with its registered office in Helsinki ("Sexync", "we", "us", "our"). By accessing or using the Platform in any way, you agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use the Platform.

2. Eligibility

You may only use the Platform if you meet all of the following requirements:

• You are at least 18 years of age. There are no exceptions to this requirement.
• If you wish to host a room, stream video, or connect a device, you have completed identity verification (government-issued ID via Didit).
• You have the legal right to access adult content in your jurisdiction. It is your responsibility to ensure that using the Platform is lawful where you are located.

By using the Platform, you represent and warrant that all of the above is true.

3. Accounts

You may register for one account per person. Creating multiple accounts to circumvent a suspension or verification requirement is prohibited.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorised by you.

• Do not share your login credentials with anyone.
• Notify us immediately at [email protected] if you become aware of any unauthorised access to or use of your account.

Sexync is not liable for any loss or damage arising from your failure to keep your credentials secure.

4. Permitted Use

The Platform is designed for consenting adults to conduct private 1-on-1 sessions involving live video, voice, real-time chat, and connected device interaction.

• Room hosts are responsible for ensuring all guests have confirmed their age before being granted access to a session.
• All participants who stream video or connect a device must have completed full identity verification.
• Use of the Platform must be for lawful purposes and in accordance with these Terms.

5. Prohibited Conduct

The following conduct is strictly prohibited on the Platform. Violations may result in immediate account termination and, where required by law, reporting to authorities:

• Minors: Any use of the Platform by persons under 18 is absolutely prohibited. This is a hard requirement with no exceptions.
• Child sexual abuse material (CSAM): Any content that depicts, describes, or sexualises minors is strictly prohibited and carries a zero-tolerance policy. We will report violations to the relevant authorities, including the National Center for Missing and Exploited Children (NCMEC) and equivalent bodies.
• Non-consensual conduct: Any activity involving another person without their clear, ongoing consent is prohibited.
• Harassment and abuse: Threatening, harassing, intimidating, or abusing any other user is prohibited.
• Unauthorised recording: Recording or distributing session content — video, audio, or chat — without the explicit consent of all participants is prohibited and may be unlawful.
• Circumventing verification: Attempting to bypass, defeat, or fraudulently complete age or identity verification requirements is prohibited.
• Unlawful use: Using the Platform for any purpose that is unlawful in your jurisdiction or that violates any applicable law or regulation.
• Platform interference: Scraping, reverse engineering, disassembling, or otherwise attempting to extract source code, data, or making unauthorised calls to Platform APIs.
• Impersonation: Impersonating another user, a Sexync employee, or any other person or entity.

6. Performer Status and Sessions

Users who have been granted performer status may create session rooms from their dashboard.

• Performers are responsible for the content and conduct of their sessions, including ensuring that all participants have completed the required verification.
• During the alpha phase, performers are solely responsible for confirming that any guest they admit to a room is 18 years of age or older. By inviting a guest, the performer represents that they have taken reasonable steps to verify this.
• Session terms — including duration, pricing, and agreed activities — are negotiated directly between the performer and their guest. Sexync is not a party to these individual arrangements and does not mediate disputes arising from them.

Alpha Phase (Current)

During the alpha phase, Sexync does not process payments. Performers are responsible for collecting payment through their own channels and arrangements. Sexync does not facilitate, guarantee, or take responsibility for any payments made outside the Platform.

Post-Alpha Payment Processing

When platform payment processing becomes available, Sexync will charge a platform fee on creator earnings processed through the Platform. The exact fee structure has not been finalised. Full payment terms, including the fee percentage and accepted payment methods, will be published with adequate notice before this feature launches. Existing alpha creators will be notified directly.

US Content Regulations

Performers who produce, publish, or stream sexually explicit content may have obligations under applicable US federal law, including 18 U.S.C. § 2257 (record-keeping requirements for producers of sexually explicit depictions). Sexync maintains age and identity verification records for performers through the Didit verification flow; however, performers are solely responsible for determining whether and how US content regulations apply to their own activities and for maintaining any records required of them as producers. Sexync does not provide legal advice — consult qualified counsel if you are uncertain about your obligations.

7. Hardware and Device Use

Sexync is a software platform. Sexync communicates with connected devices using SexCode — an open-source control protocol published by Sexync under the CC0 public domain dedication. SexCode is free for anyone to implement without restriction.

Supported devices are the OSSM (Open Source Sex Machine) via USB-serial connection, and devices compatible with the third-party Buttplug.io protocol, connected through the Intiface Central application. Buttplug.io and Intiface Central are developed and distributed by third parties; Sexync is not responsible for their behaviour. SexCode firmware for the OSSM (ossm-sexcode) is published by Sexync under the CERN-OHL-S-2.0 licence at sexync.gitlab.io/ossm-sexcode. Publishing this firmware does not make Sexync responsible for its behaviour on your hardware. No warranty of any kind is given — see the notice below.

Specifically, you agree that:

• You will familiarise yourself with your device's physical limits, safety features, and emergency stop functions before connecting it to the Platform.
• You are solely responsible for the safe setup, operation, and maintenance of any connected device.
• You will operate your device only within its manufacturer's specified parameters.
• Sexync is not liable for any personal injury, property damage, or any other loss arising from the use of connected hardware.
• Sexync publishes the SexCode protocol and ossm-sexcode firmware as open-source projects. This publication does not constitute a warranty of fitness for any purpose. Firmware behaviour, compatibility, and updates are your responsibility. Sexync accepts no liability for any harm arising from running this firmware on physical hardware.

8. Intellectual Property

The Sexync name, logo, interface design, and platform code are the property of Sexync and are protected by applicable intellectual property laws. You may not use our branding without express prior written permission.

You retain ownership of any original content you create. Sexync does not record, capture, or store the live video or audio of sessions. Text chat messages, however, are transmitted through and stored on our servers, as described in our Privacy Policy.

By using the Platform, you grant Sexync a limited, non-exclusive, royalty-free licence to process your content to the extent necessary to provide, secure, and operate the service — for example, transmitting your live video and audio in real time within a session room, and transmitting, storing, and displaying your chat messages so that conversation history is preserved and can be moderated. Except as described here and in our Privacy Policy, this licence does not extend to the reproduction or public distribution of your content, and we do not record session video or audio.

9. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

• Sexync does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
• Sexync does not endorse, control, or take responsibility for the content, conduct, or representations of any user within a session.
• The Platform is in an early alpha stage. Features may be added, changed, or removed without notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the operator of Sexync and any associated individuals, contributors, or agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of data, loss of revenue, business interruption, or personal injury.

Given that the Platform currently processes no payments and charges no fees, our total aggregate liability to you for any claim shall not exceed USD $100.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under the mandatory law that applies to you (including mandatory consumer-protection law). If any limitation in this section is held unenforceable, the remaining limitations continue to apply to the maximum extent permitted by law.

11. Termination

Sexync may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for conduct that we reasonably determine to be harmful to other users, the Platform, or third parties.

You may close your account at any time via your profile settings. Upon termination — whether initiated by you or by us — your right to access and use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 8, 9, 10, and 12) will continue to apply.

12. Governing Law and Disputes

These Terms, and any dispute or claim arising out of or in connection with them or your use of the Platform, are governed by the laws of Finland, without regard to its conflict-of-laws rules.

The courts of Helsinki, Finland have jurisdiction over any such dispute. If you are a consumer resident in the European Union, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of the country in which you live, and you may also bring proceedings in the courts of that country.

Before pursuing formal proceedings, Sexync will make reasonable good-faith efforts to resolve any dispute directly with affected users.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email or by posting a prominent notice on the Platform before the changes take effect.

Your continued use of the Platform after updated Terms have been posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform.
